Any new tenancies following the Housing Act 1996 are assured shorthold tenancies, unless made assured, but it is still important to have a valid agreement because it details the terms and conditions, the obligations and the duties of both the landlord and the tenant.  Without a valid assured shorthold a Landlord cannot rely upon the acclerated possession route which is a fast effective procedure for obtaining possession.
