Our Debt Enforcement Procedures:
The Court Bailiff
A County Court Bailiff can recover goods to the value of the judgement debt.
3rd Party Debt Order
Which means ‘freezing a bank account’ until the court grants an order allowing the judgment debt to be 'released to the landlord'
We feel this only works if you are already aware of the tenants details from previous payments they may have made to you. You can apply for an oral examination at Court if you are unaware of the details, however the debtor may have removed the money from the account by the time the Order is obtained.
Charging Order
If the person owns a property, we can place a charge on it. This will mean that the debtor cannot sell or possibly re- finance the property without paying off the debt.
In order to make sure the tenant owns the property we can obtain a search at the Land Registry, the cost of the search is £6.00.
An Attachment of Earnings
This is another favourite way of enforcing the debt as the money is taken from the salary at source. It is also very embarrassing because the employer needs to be aware of the debt.
Obviously this is only successful if the debtor is in employment.
You can also apply for the money to be deducted from benefits, but the amount of recovery is very small and will only apply if there are no other pre-existing debts taken out of the benefits.
Bankruptcy
This can be expensive and only works if the person does not have other debtors who have priority debts and if the tenant cares he/she is going to be made bankrupt. Also, the debt must be valued over £750.00.
You can apply for an oral examination at Court, where the person is forced under oath to tell you his/her assets and whether they work or not, but the costs increase if you have to apply for an oral examination.
