Parental Responsibility
Biological Mothers automatically have parental responsibility. We can assist fathers in determining whether they have parental responsibility for their children. Parental Responsibility allows parents to make decisions regarding their child’s upbringing including issues such as education and religion.
Contact and Residency Applications
We act for both the mother and father in relation to childcare matters, with successful claims on behalf of both. We aim to obtain the best result for both the parent and the child.
We also oppose contact applications where a parent feels that there is significant harm to their child.
We always advise clients to attend mediation as it is in the best interests of the child for parents to reach an amicable decision. The Courts like to promote contact with both parents unless the child is at risk but they are reluctant to make order unless absolutely necessary. This is not always possible and subsequently we support our clients through the Court process and CAFCASS reports.
Extended family also have rights regarding contact.
